AEW ANNOUNCES SIGNING OF EDDIE KINGSTON

After impressing on the microphone and in the ring in his debut appearance for the company, Eddie Kingston is now officially part of the AEW roster.

AEW announced today that the 38-year-old Kingston has signed with the promotion: "Welcome to the team #MadKing #EddieKingston is #AllElite #SignEddieKingston is now #EddieKingstonIsSigned"

Kingston responded to AEW's announcement on Twitter: "The #StrayDog is off the chain."

Kingston appeared on Dynamite last week and answered Cody's TNT Championship open challenge. The hashtag "#SignEddieKingston" gained traction on Twitter after the match.

That Long Saga Of Jarrett VS Anthem That Won't End? Still May Not Be Ending As A Mistrial Has Been Declared.

United States District Court of The Middle District of Tennessee Chief Judge Waverly D. Crenshaw, Jr. officially declared a mistrial earlier today in the Jeff Jarrett and Global Wrestling Entertainment vs. Anthem Wrestling (parent company of Impact Wrestling) lawsuit, PWInsider can exclusively confirm.

As reported earlier today, Anthem filed for a mistrial after the verdict came in from the jury, claiming that Jarrett's attorney had prejudiced them by noting that Anthem's Ed Nordholm was not present on 7/20 for court proceedings as he was in attendance at an Impact Wrestling TV taping that was ongoing at the same time due to the court moving their scheduled return to session up one day at the last minute,  Anthem's attorneys also claimed that by Jarrett's attorney bringing up financial numbers during the liabilities portion of the closing arguments when it had been stressed by the court that those were to be left for discussion when it was time to cover potential damages and punitive damages, he had also prejudiced the jury.

After a two and a half hour hearing today, Chief Judge Waverly declared a mistrial.  He ordered a 9/11/20 status conference to begin the process of setting up a new trial.  He also ordered that the GFW Amped! tapes be preserved.

The verdict reported earlier today by PWInsider.com has been vacated by the court.  The jury in the initial trial has been dismissed. 

What does this mean? It means that the two sides - Jarrett and Anthem - have two courses of action before them.  They can use this as another chance to settle the matter or they can wait and set a new trial date this September.  Should they choose the latter, each side starts from scratch with a brand new jury, spending more money to go through the legal proceedings yet again.

FINALLY .. WE HAVE A VERDICT IN THE JARRETT VS. ANTHEM SOAP OPERA... BUT....

Anthem Wrestling, the parent company of Impact Wrestling, filed a 50-page motion on 7/29 before the United States District Court of The Middle District of Tennessee, requesting that Chief Judge Waverly D. Crenshaw, Jr. declare a mistrial, which would effective force the trial to start from scratch even though the jury has brought back a verdict in the case.  Jarrett's side filed a response this morning in advance of a scheduled hearing at 9 AM Central time to determine whether a verdict brought by the jury will stand or if the entire process will be rebooted.   Based on court filings made, the jury was split among the issues brought to light at the trial.

*The jury ruled that Anthem Wrestling Exhibitions, LLC is liable to Plaintiff Global Force Entertainment, Inc. for federal trademark infringement of the registered mark GLOBAL FORCE WRESTLING, violation of the Tennessee Consumer Protection Act, unjust enrichment, negligence, conversion, and federal unfair competition for infringement and Tennessee trademark infringement for usage of the GFW logo.

*The jury ruled that Anthem Wrestling Exhibitions, LLC is liable to Plaintiff Jeffrey Jarrett for violation of the Tennessee Personal Rights Protection Act.

*The jury ruled Anthem Wrestling Exhibitions, LLC was liable for federal trademark infringement of the mark GLOBAL FORCE WRESTLING.

*Anthem Wrestling Exhibitions, LLC is liable for unfair competition for infringing upon the GFW logo.

*Anthem Wrestling Exhibitions, LLC is liable for Tennessee trademark infringement for usage of the GFW logo.

*The jury ruled in favor of Global Force Entertainment, Inc. on its unjust enrichment claim, ruling that Anthem used the GFW content for their own enrichment without having the license to do so.

*The jury ruled that that Anthem Wrestling Exhibitions, LLC was negligent in deleting the original footage of the GFW Amped content.

*Anthem Wrestling Exhibitions, LLC is liable for conversion for its deletion of the original footage of the Amped content.

*However, the jury ruled that Anthem Wrestling Entertainment, LLC’s liability in this action was caused by Jeff Jarrett’s own breach of his fiduciary duty and his duty of loyalty and that Mr. Jarrett is liable to Anthem Wrestling for such breaches, so there may be damages he has to pay to Anthem.

*The jury ruled that Anthem’s conduct against Jarrett/GFW was willful.

While the jury came back with those verdicts, they have yet to award damages or punitive damages and Anthem is attempting to have everything thrown out of court to restart the entire trial process all over again.  We have broken down why and what the Jarrett side's response was this morning.

ANTHEM REQUESTS MISTRIAL RULING

Whether the jury had been prejudiced by Jarrett's side is a major bone of contention from the Anthem side, leading to their motion on 7/29.

Anthem's motion claims that Jeff Jarrett's attorney Samuel Miller made a statement on 7/21 that prejudiced the jury during his closing argument by mentioning that Ed Nordholm was not present for the court proceeding that day.  Jarrett's attorney made the mention despite Anthem's attorneys specifically requesting that the court bar that from being mentioned, which the court agreed to.

The back story there is that the trial had been postponed for several weeks out of concern that someone on Anthem's legal team may have been exposed to COVID-19, requiring the delay.  Initially the trial was to resume on 7/21, but due to scheduling concerns with members of the jury, on 7/17, the court opted to resume the proceedings on 7/20.  Since Impact Wrestling was taping TV that entire day, Anthem informed the court that Ed Nordholm and Scott D'Amore could not attend the trial that day due to the last minute rescheduling, and instead Anthem sent their Chief Financial Officer Niral V. Merchant to attend with the court's blessing.

During his closing arguments, Samuel Miller stated, "When we started this jury -- ladies and gentlemen of the jury, when we started this trial three weeks ago, I told you three things. One, Anthem had a problem. That problem was Mr. Nordholm, who is not here today. We proved that Mr. Nordholm was the problem."

Anthem's motion yesterday noted:

Mr. Miller was clearly indicating that Mr. Nordholm is a problematic individual who did not even bother to attend the closing arguments. Plaintiffs’ strategy throughout the trial was to portray Mr. Nordholm as the villain. Pointing out his absence against the order of the Court and with knowledge of Anthem Wrestling’s concerns, was a continuation of this strategy to turn the jury against Anthem Wrestling.

Second, while this statement was made only once, it was made during a crucial time of the trial. While not binding precedent on this Court, a Tennessee court has recognized that even if the offending comment was “not part of a pattern” and “happened only once,” an improper statement can be the basis for a mistrial when “it occurred during closing argument, a critical point in the trial just before the case went to the jury.

Third, Mr. Miller’s comment served no purpose whatsoever except to prejudice the jury against Anthem Wrestling, disrupting the tribunal and the administration of justice. Mr. Nordholm’s absence from closing arguments had no relevance to or impact on the issues that the jury was deciding. Pointing out Mr. Nordholm’s absence was intentionally done to achieve Defendant’s expressed concern: prejudicing the jury by making them believe that Anthem Wrestling’s representative did not care about the matter at hand and was not taking the trial seriously. Considering the fact that the Court had already ordered the parties not to make such statements and Defendant’s counsel had informed the Court and Plaintiffs’ counsel of its concern in writing that the rescheduled date and absence of Mr. Nordholm would prejudice the jury, the nature of Mr. Miller’s improper comments is even more problematic. Fourth, while the Court instructed the jury to disregard Mr. Nordholm’s absence, the cat was already out of the bag once Mr. Miller pointed out that fact. Within the context of Mr. Miller’s repeated strategy to paint Mr. Nordholm as the villain and the statement’s total lack of relevance to the issues of the case, Mr. Miller’s statement could not be cured with an instruction.

Fifth, it is likely that the case was very close at the time of closing arguments. The intellectual property issues at this case were very complicated, and, in addition to Plaintiffs’ evidence, Anthem Wrestling put on substantial evidence of multiple defenses. Finally, the jury returned a verdict holding Anthem Wrestling liable on most of Plaintiffs’ claims and found that Anthem Wrestling acted willfully on multiple claims.

Anthem attorneys also alleged that Miller "prejudiced the jury by repeatedly referring to large monetary amounts and alleged damages against the Court’s order to reserve that aspect of the case for the damages phase of the trial."

The court had broken down issued that resulted in the trial taking place into several portions in order to keep it simplified for the jury - liability, damages, and punitive damages, so the jury could rule on them separately.  They could, for example, decide Anthem was responsibile but that there were damages but no punitive damages.

Anthem cites in their motion that Jarrett's attorney kept bringing up financial numbers and potential damages despite being instructed by the court not to do so.

During his closing argument, Miller stated, "The production costs were, in reality, based on [Ed Nordholm's] testimony, over $100,000 per hour of content. That means just to produce the 12 hours of content would have cost Anthem $1.2 million. The benefit of saving $1.2 million dollars was huge. Anthem wants you to believe it could have replaced the content for $25,000 an hour. But they don't tell you how they came to that number. Mr. Nordholm told you he left out paying for talent. He told you he left out paying for lighting. He told you he left out paying for everything else involved in creating new content."

This led to Anthem's attorneys objecting as they were dealing with the liabilities portion of the case, not the damages.  Judge Crenshaw responded, “Okay. Noted. This -- ladies and gentlemen, this is closing argument. It is not evidence. And I'll give you further instructions on that when I give you the jury charge. Go ahead.”

However, according to Anthem, Jarrett's side kept "continued to make statements regarding evidence the Court had ruled to be inappropriate for this phase of the trial. Mr. Miller repeatedly stated that Anthem saved a lot of money from using the content at issue and that Defendant never paid Plaintiffs for the use of such content and intellectual property. These statements were so prevalent and problematic that the Court, in the middle of Mr. Miller’s closing argument, had to order the jury to leave the room and admonish Mr. Miller."

Court records indicate Crenshaw did indeed admonish Miller, telling him, "Mr. Miller, you've gone too far. This is on liability only. I gave you some leeway, but now you're continuing to come back to the issue of what money is due. Repeatedly. Now, either I can clean it up or you can clean it up, but it needs to be cleaned up. … We're only on liability. So there's no need for your continued argument about what money is due. It's just not. … You're not in the damages phase now. And you're specifically and over and over again asking the jury to make a decision on liability because they're due something. We're here only on the theories that you've put forth and whether or not any of those theories have been established by preponderance of the evidence."

The jury, who had been removed before Crenshaw's comments to Miller, were brought back into the court room and told, "Ladies and gentlemen of the jury, I want to share with you that in the instructions that I'll give you, you will learn that the case right now is only on the claims of the plaintiff against the defendant and the defendant's claims against the plaintiff. And that's the decision that I'm going to ask you all to make. Whether or not the plaintiff or the defendant may or may not be entitled to anything depends on your decision that -- that I'll give you on the first stage of the case. So, therefore, what the lawyers are telling you now, first of all is, is not evidence. You've heard all the evidence. And you'll be the judges of how much weight to give to the evidence you've heard. And I'll give you instructions that you can consider all of it, some of it, or none of it at all. But what the lawyers -- as I told you in the beginning say -- is not evidence. So they may make reference during their closing to things that are not at issue here at this point. And to that extent you have to follow the instructions that I'll give you, as I told you when you were selected, whether you agree with those instructions or not. So with that, Mr. Miller, you have a few minutes left."

Despite those instructions, Anthem has argued that Miller had prejudiced the jury against them with his statements, writing, "The totality of the circumstances shows that Mr. Miller’s improper conduct created a reasonable probability that the jury would influence the verdict and a new trial should be granted."

Anthem is also arguing that jury instructions given were incorrect due to the breaking apart of the three portions they were to rule on - liabilities, damages and punitive damages.  While the jury instructions were to simply focus on the liabilities, according to Anthem's legal team, "the instructions submitted by the parties that explained the consequences of finding willfulness and the purpose of making such a determination—the award of punitive damages—was withheld from the jury. Similarly, the verdict form simply asked whether the jury found that Anthem Wrestling acted with the requisite mental state but did not notify the jury of the consequences of such a finding."

Now, the response from the Jarrett side, which was filed this morning.

JARRETT'S SIDE ARGUES NO MISTRIAL SHOULD BE ORDERED

This morning, Jarrett's side filed a 19-page response to the mistrial request, arguing it should be denied.  While denying that the comment made about Nordholm was even improper, Jarrett's side stated that the issue had been handled by Judge Crenshaw right there in the moment and that should therefore be considered settled and should not be considered part of the "high bar" necessary to require a new trial.  Arguing that it should fall upon Anthem to prove a new trial was necessary, Jarrett's side argued (as one would imagine they would) that Anthem had not met that requirement.

Jarrett's side also stated they did not intentionally violate any order from the court to not mention Nordholm not being at that day's proceedings, writing, "Plaintiffs’ counsel was genuinely surprised by the Court’s admonishment for violating an instruction regarding Mr. Nordholm’s absence for two reasons. First, Plaintiffs’ counsel truthfully does not recall the Court giving an instruction during the July 17 telephone conference that neither party could not point out Mr. Nordholm’s absence to the jury.1 In its Motion, Anthem does not cite to any page of a rough transcript for the Court’s instruction regarding Mr. Nordholm’s absence."  They requested a draft of the transcript of the phone call when that edict was issued.

Jarrett's attorneys argued:

If there was such an instruction, Plaintiffs’ counsel certainly did not intend to violate it. Given the various moving parts of this particular trial, it was an honest mistake to not recall the telephonic oral instruction. It was not intentional. Certainly, no attorney wants to do anything that would have an opening statement stopped by the judge within the first few seconds, which is what happened here. There is no benefit to an attorney having a closing statement interrupted.

In fact, prior to Anthem’s Motion, Plaintiffs’ counsel could not understand where such instruction could have been given because the Court’s instruction immediately prior to closing statements pertained only to COVID-19 and the unavailability of anyone due to that illness. Nobody said at any time Mr. Nordholm could not attend due to COVID-19.

To the contrary, Anthem’s counsel represented on July 19, 2020 that Mr. Nordholm could not attend due to another alleged other commitment.

Jarrett's side also argued that the financial numbers brought up during their closing arguments were necessary towards showing that Anthem was liable for damages suffered by Jeff Jarrett and Global Force Entertainment.  Their argument:

Anthem has not met its burden of showing Plaintiffs’ counsels statements were improper.

 First, phrases relating to the amount of money Anthem saved in production costs were necessary to proving the unjust benefit conferred on Anthem by using the Amped content at the liability stage of the trial. Indeed, the jury instructions for unjust enrichment at the liability phase defined “benefit” as “any form of advantage that has a measurable value including the advantage of being saved from an expense or loss.”

To meet its burden of proof for unjust enrichment, Plaintiff GFE had to prove the measurable advantage that Anthem received from using the Amped content. In trial, Ed Nordholm was impeached through his prior deposition testimony that the cost per hour of production for Impact! in 2017 was “in excess of $100,000.” (Rough Trial Tr. 86:18-87:7, July 2, 2020). 4 Defendant did not object to this line of questioning during trial. Anthem’s benefit, therefore, was the cost savings of not having to create and produce twelve hours of wrestling content to meet its deliverable obligations. The measurable benefit was the $100,000 per hour. This was admitted without objection in the liability stage because it was clear it went to the measurable benefit for unjust enrichment. Because Anthem used twelve hours

Anthem’s counsel stated at the post-verdict status conference, “I don’t think [the jury] even realized they needed to be paying attention to numbers and so forth” and noted that she believed the jury was “shocked” they were coming back to make a damages determination. (Post-Verdict Hr’g Tr. 43:1-3, July 21, 2020). It is disingenuous for Anthem to simultaneously state that the jury did not know it would be making a damages determination and also be prejudiced by argument related to how much GFE was damaged. 4 Plaintiffs have not yet received the final version of the trial transcripts.

Accordingly, the cites in this brief are to the rough draft provided by the court reporter to generally guide the Court on where to find the citations in the record. Case 3:18-cv-00749 Document 259 Filed 07/30/20 Page 6 of 19 PageID #: 4595 7 of the Master Amped Content to meet its deliverable obligations, the total benefit was $1.2 million (i.e. $100,000 x 12 = $1.2 million).

The nature of these comments therefore could not be prejudicial to Anthem because it came into evidence during trial and were necessary to proving GFE’s unjust enrichment claims. Anthem was in no way prejudiced. Second, Plaintiffs’ counsel had a duty to counter Anthem’s unjust enrichment counterclaim. The third element of the unjust enrichment counterclaim required Anthem to prove “GFE’s or Mr. Jarrett’s acceptance of such benefit under such circumstances that it would be inequitable or unjust for them to retain the benefit without payment of the value thereof.”

Anthem stated in its closing argument the alleged measurable value on its own unjust enrichment claim, namely the $40,000 payment to Kevin Sullivan. (Rough Trial Tr. 67:20-22, July 20, 2020). To show that any alleged benefit was not unjust or inequitable Plaintiff had to show that the value of the cost savings from using the Master Amped Content far exceeded the alleged benefit to GFE for the $40,000 payment to Kevin Sullivan. Third, to counter Anthem’s affirmative defense of implied license, Plaintiff GFE had to show that there was no agreement to use GFE’s trademarks and logos unless the merger was completed. Anthem referred to a “contract” five times in its closing argument. (Rough Trial Tr. 55:25-1, 58:2-4, 65:25-66:4, 71:6-9, July 20, 2020).   Anthem also claimed the license was “legally binding.” (Rough Trial Tr. 58:2-3, July 20, 2020).

To show there was no agreement and therefore no “legally binding” license or contract, Plaintiff had to prove there was no consideration and no “bargain for exchange.” Plaintiff, indeed, never received anything in exchange for Anthem’s use of its trademarks and logos. There was no consideration, therefore, there was no license. Plaintiff’s counsel’s statements that Anthem was claiming it had a “free and forever license” highlighted the fallacy in Anthem’s defense. Because the nature of the comments was true, and necessary to counter Anthem’s affirmative defense, Plaintiffs’ counsel’s statements were not improper and in no way prejudiced Anthem. Finally, the total value of the benefit (which is at least the $1.2 million in production costs savings) also goes to showing Anthem’s willfulness and intent for conversion, negligence, unjust enrichment, and violation of the Tennessee Consumer Protection Act. Anthem decided to use GFE’s content and trademarks for its own benefit long after the merger was terminated because the benefit of doing so was so great. Showing the great value of Anthem’s benefit was significant to proving that Anthem’s actions were intentional and willful and the motive for willfully and intentionally taking those actions. For the foregoing reasons, Plaintiff’s statements pertaining to the measurable benefit were not improper because they involved facts that came into evidence and were necessary to prove Plaintiffs’ claims and rebut Defendant’s counterclaims and defenses. Similarly, showing the fallacy of Anthem’s repeated representations that there was a “contract” or “agreement” is both fair and necessary to defeat that defense to both infringement and unjust enrichment (i.e. Anthem claimed at closing that the existence of a contract bars an unjust enrichment claim). Even if this Court disagrees, the Court’s multiple curative instructions resolved any potential prejudice. Clarksville-Montgomery Cty. Sch. Sys. 925 F.2d 993 at 1002 (“[W]here such prejudice is cured by instructions of the court, the motion for a new trial should be denied.”).

Jarrett's side also argued that since there was a mixed verdict with each side receiving rulings on different issues, that itself is proof that the jury was not prejudiced against one side, arguing

Here, the jury returned a mixed verdict. The jury did not find in favor of GFE on all trademark issues, did not find in favor of Mr. Jarrett on his cancellation claim, and found in favor of Defendant on its claims of Breach of Fiduciary Duty and Breach of Loyalty. This mixed verdict indicates that the jury was not prejudiced by any statements made by Plaintiffs’ counsel during closing and should weigh against granting a new trial.

Jarrett's motion this morning also stated:

The jury found that (1) Defendant’s violation of the Tennessee Consumer Protection Act were willful and knowing; (2) Defendant’s conversion of the original Amped files of the 16 episodes was done by fraud, ill will, malice, recklessness, wantonness, oppression, insult, willful or conscious disregard of the plaintiff's rights Global’s rights and/or other aggravating circumstances; and (3) Defendant’s use and/or destruction of the original Amped files for the 16 episodes were intentional or reckless.

As you might imagine, Jarrett's side is taking issue with the jury instructions being a problem as well.

There is slated to be a hearing today in Nashville, which depending on which side the court rules for, will either mean that the jury will move forward into determining damages and punitive damages...or that this all starts back at the beginning of the trial process all over again.

At the center of the case has whether Impact Wrestling retained the rights to continue to use footage of Global Force Wrestling's Amped! TV taping footage, which Jarrett (at the time Chief Creative Officer of the company) made the call to use.  Jarrett is claiming that after his termination, Impact no longer had those rights.  Exacerbating the situation is that Impact had the masters from the GFW footage deleted from their servers, which Jarrett is claiming has prevented him from trademarking the content and is a huge financial loss.  Impact has claimed the company only generated $10,000 in revenue from using GFW content and selling it on DVD and PPV.  Jarrett is also attempting to wrest the rights to the trademark of his name away from Anthem, which acquired it as part of their takeover of the company when they foreclosed on the debt Dixie Carter's Impact Ventures had accrued from Anthem banking the production of TV tapings.

The two sides had several settlement discussions over the course of the legal process but were unable to come to terms.

NWA World Women's Champion Thunder Rosa will be defending her title against "The American Kaiju" Lindsay Snow at Hell Hath No Fury.

Hell Hath No Fury is an event by Mission Pro Wrestling. The date of the event is September 18, 2020 and fans can buy tickets here.

It will also be streaming live on Title Match Network.

Thunder Rose won the NWA Women's Title by defeating Allysin Kay at the NWA Hard Times PPV in January. She would later successfully defend the title against former WWE star Melina on an episode of NWA Power.

Nick Aldis Takes Shot Again At Bruce Prichard For Declining WWE Ratings

NWA World Heavyweight Champion Nick Aldis took to Twitter to address Executive Director of SmackDown and RAW Bruce Prichard's comments on Aldis saying that he doesn't have the "It Factor". Aldis said he would talk more about Prichard's comments on Busted Open, and Aldis did just that.

"Well, you've seen some of my reactions. Bubba knows that 10 years ago, I might have reacted slightly differently," Aldis admitted. "I may have been slightly more reactant in general. This time I took a moment to process it. Bruce and I even spoke on the phone.

"Bruce claimed, 'Oh I was talking about the Magnus character. I wasn't talking about Nick Aldis.' OK, well, his team uploaded a video that was a separate clip, and they had a picture of me with the NWA Title. The same title that Harley Race, Ric Flair [and] Dusty Rhodes held. The same lineage I busted my ass to rebuild and put into the Modern Era, and they used my name. So, he's full of sh-t is the reality."

Aldis worked for TNA from 2008-15 before returning to the company for a year in 2017. Aldis talked about the opinions that other WWE Hall of Famers and wrestling legends have on him while also taking a shot at Prichard's TNA runs in 2010-2013 and 2017.

"Honestly, what he did was just expose the fact that he hasn't been paying attention to anything that's been going on," Aldis stated. "Because like you said, anyone who has seen my sh-t the last three years, the one consistent thing that comes up from everybody, from Mark Henry, to Hall of Famers, Harley Race, Dusty Rhodes, even tippy-top guys in WWE who have text me privately, whose names I won't mention. They all say the same thing, which is 'You have that thing. You send yourself like a real pro wrestler. The kind of wrestling that I miss. The kind of wrestling I thought wasn't here anymore.' And for Bruce to say that, it just showed that he hasn't been paying attention, kind of like when he was running TNA.

"He wasn't paying attention. He was asleep, and the reality is he took a shot and he tried to give some half bait reason to why he decided to say it and whatnot. [He said] he was going to address it. Did not. Let it breathe. So now, he's getting a receipt. He's not getting a fu--ing receipt, he's getting a fu--ing invoice is what he's getting. There's different Hall of Famers who have a different opinion, and he likes to float things out that are subjective and sort of present it as fact.

Aldis again took a shot at RAW's current ratings while also saying that Prichard was responsible for TNA's down ratings. He talked about how the ratings went up after Prichard left and when he became TNA World Champion.

"He lives in this past sort of mentality, where he thinks because he's WWE, he can just say whatever about someone and that's the only thing anyone will hear and that will be the opinion everybody shares," Aldis remarked. "Well, it doesn't work like that anymore. Times have changed. People fact check. People can go present their opposing opinion and you know, I'll follow up with facts if he wants to go there because by the time Bruce was relieved of his duties in TNA in 2013, he brought the viewing figures down to like 1 million people.

"By the time I had the World Title at the end of that year and through the start of 2014, we got the average going figures back up to like 1.3 and peaked at 1.55, which was just short of 1.561, which was the lowest RAW rating in history, which was the rating that came out the same week that he decided to trash me on his podcast. I guess that maybe that extra bit of rating that RAW got must be the 'It Factor' I don't have."

Jim Ross On Which WWE Star The Company Dropped The Ball On Regarding Promos

On a recent episode of the Grilling JR Podcast, Jim Ross talks about the career of Bobby Lashley. Throughout the episode, JR discussed how he was receiving many comparisons to Brock Lesnar since debuting with WWE. Ross discussed Vince McMahon meeting Lashley and the comparisons with Lesnar.

"He didn't meet Bobby in the grandiose way that he met Brock Lesnar, apples and oranges here," Ross said. "The comparison was physical. Lashley had this great strength, amateur background, he looked great, all the same things you can say about Brock. We've got another heavyweight amateur star that we've got great expectations for, I can describe when we first signed Brock the same exact way."

When Lashley finally made his main roster debut in September of 2005, he was introduced as a four-time All-American, 2002 Silver Medalist at the Military World Championship, a two-time Armed Forces Champion and a three-time National Amateur Champion. Lashley was put on the similar path to Kurt Angle and Brock Lesnar when they debuted with the company. JR noted that Vince had a new toy in Lashley and how he may have brought him up too soon compared to Lesnar or Angle.

"Vince had a new toy that he loved to look at," Ross said. "Could Bobby have used a little bit more time in the farm or working the second or third match on house shows? Yes, he should've had more time. I had the same battles with Vince about Brock Lesnar. Creative wanted to bring Brock Lesnar up earlier than I wanted him to go and I simply told Vince 'He can't protect anybody right now, he's still learning things and he's so god damn strong that a small calculated error could be disastrous.'"

Ross mentioned Shelton Benjamin as another star who may have been pushed too soon. Ross mentioned how he believes the WWE fumbled with Benjamin by not having him work with other stars to enhance his promo skills. JR feel that fumble cost them a massive star.

"If we had spent more time with Shelton Benjamin on his promos, we would've had a major major star on our hands," Ross said. "There was nothing, absolutely nothing, in the ring Shelton Benjamin couldn't do and that holds true today. He's a freak of nature athletically and a good human being. We should've cut him from the herd and put him with somebody so he can have practice on the mic and talking than he did drills in the ring. That's our fumble, we messed that up for him."

As of late, Bobby Lashley has joined up with MVP and Benjamin to form their own alliance, The Hurt Business. Ross talked about the grouping of Lashley and MVP and how he sees the two potentially exploding because Lashley can handle his own now and doesn't need a mouthpiece anymore.

"At some point sooner or later, MVP and Bobby will be an issue and Bobby will have matches with MVP soon," Ross said. "I think Bobby is at the level now that he doesn't need a mouthpiece to the degree he needed it [back] then. I like the package of MVP and Bobby together, a lot, but it's just the matter of Bobby getting better and getting the confidence to cut good promos. I think that day is almost here."

EC3 Talks What Went Wrong In WWE, Meetings With Vince McMahon, If Impact Was His Only Option

Dave LeGreca and Bully Ray welcomed Impact Wrestling's EC3 onto the Busted Open podcast to talk about his WWE run and what went wrong in WWE. EC3 talked about the micromanaging in WWE and the lack of trust within the leadership.

"Yeah like with anything, it starts at the top, and I think the very very top is micromanaging [at an] extremely dangerous level where there is no trust in the Lieutenants, majors, and generals to do anything," EC3 stated. "Everything goes through the top and what the top's inundated with. So much business gets lost, I believe you had EY (Eric Young) on here and you mentioned there's a broken system. It seems like it.

"I'm not following the product, but they have the most talented roster in the world, and the product becomes unwatchable and insufferable sometimes. As a leader, instead of passing blame to people and firing them, sometimes it comes down on me and so leadership starts at the top."

EC3 gave his opinion as to why his WWE career wasn't taking off after returning as EC3. He talked about already being established and the feeling in the company that they didn't need to work on anything else with him since he had a fanbase during his debut.

"I started with a great match to kick it off," EC3 noted. "I think the problem was, I created such a self-made brand and individuality and persona that when they threw me out there, I was already very popular and 'over' that they realized we don't have to worry about this kid and nobody took it upon themselves to manufacture what I was to them.

"When it becomes nobody's project, you can just fall into the complacency of being a popular act or semi-over. So I think that's part of it. Plus, NXT is mostly a stomping ground cause we think my skills would be for main roster kind of talent."

EC3 also talked about his call-up to the main roster being rushed as well as his return from his injury being rushed as well. He stated that he is currently happy now and hopes to take "the narrative of the wrestling world" and Impact Wrestling to different places.

"When I did get called up, it was a rush call up," EC3 admitted. "My mistake was trusting the process and believing there's a reason for it as opposed to it was a rash decision because they were feeling heat for some reason. My mistake was thinking that it was for a reason. I take full accountability for that. Plus they called me up and I was out with an injury. I was rushed back from injury. I was not in a good place physically and mentally.

"Whatever. It did not work and that's fine because it not working has made me create something I'm finally happy and proud of and hopefully can take not only to Impact Wrestling but to the narrative of the wrestling world in various different locations. I think various different locations are ripe to take over this scene I think coming."

EC3 is back with Impact Wrestling, but he noted that Impact was not his only option after leaving WWE. He teased he has things in the works in other places that almost no one knows about.

"Absolutely not. Every option was and is on the table," EC3 revealed. "What I'm doing is controlling the narrative. I have things in works in multiple locations and plans to hopefully bend the narrative and confuse people. I love the fact nobody knows what I'm doing."

EC3 was one of many people released as part of budgetary cuts made by WWE during the COVID-19 pandemic. He was asked if he would be in a more comfortable position if the pandemic never happened.

"I would have, post-WrestleMania, request my release privately," EC3 revealed. "I would not have been the guy who takes his business public, trying to get out. I would have a man-to-man conversation to whoever it was worth and their decision may have been yes, may have been no.

"I think I had people in my corner, but nobody that would openly step up because everyone is scared and apprehensive and no one wants to rock the boat. So they're like 'Man I can't believe they don't let you talk'. You're in the production meetings. You can say something."

EC3 was also asked if he had ever opened up to Vince McMahon. He said he's had one-on-one meetings with McMahon, but the two never saw eye-to-eye in terms of the direction of his character.

"I've had one-on-ones with Vince," EC3 said. "They were always good and instructive and he saw me for what I am. 'Look good, work good'. I'm not like the workhorse. He doesn't make money off those guys. He makes money off guys who have charisma which I have. He saw one promo and thought it was over the top. I'm like, 'well that was one, and I can always scale it back. Yeah, it's funny that you don't talk.'

"'It's only killing me inside. It's cool. Your show, great.' There were those meetings where you feel good walking out, but nothing ever happens. Pitched him a bunch of different ideas. Showed him a video of me and Drake Maverick he goes 'Oh this is great!', but nothing happens."

PRO WRESTLING NOAH, DDT MERGE INTO SINGLE COMPANY

DDT and Pro Wrestling NOAH will soon merge into one promotion.

A press conference was held this morning to announce the merger of the two companies into one promotion, which will be called CyberFight. The promotion will be named after DDT and NOAH's parent company, CyberAgent. These changes will go into effect on September 1.

Both promotions, as well as Tokyo Joshi Pro Wrestling and GanPro, will continue to operate as separate brands within the promotion. Sanshiro Takagi, who recently took over as president of Pro Wrestling NOAH in January, will serve as president of the new promotion with NOAH star Naomichi Marufuji and DDT star Akito serving as EVPs.

In the press conference, Takagi stressed that the in-ring content of both promotions will remain the same. He said that the move to merge the companies is a result of the COVID-19 pandemic and the need to streamline costs. He also said that one of his goals is to run the Tokyo Dome.

FATU-MLW SIGNING, ADDITIONAL TALENTS LOCKED INTO NEW DEALS

MLW Champion Jacob Fatu's new deal with Major League Wrestling gives the promotion exclusivity on Fatu through 2025 and would specifically prohibit him from performing for WWE and AEW.  The original MLW deals talents signed only prevented talents from working for WWE but with the emergence of AEW last year, all exclusive MLW deals have been re-worked to become more exclusive in nature.

Fatu is among a number of MLW talents who have signed new or re-worked contracts with the company, following MLW National Openweight Champion Alex Hammerstone, Richard Holliday, MLW Middleweight Champion Myron Reed and Salina de la Renta.

MARIA KANELLIS AND MIKE BENNETT DISCUSS THEIR WWE RELEASE, AND MORE

The following excerpts from Mike Bennett and Maria Kanellis Bennett’s appearance on the “ROHStrong Podcast,” hosted by Kevin Eck, were released today. The podcast dropped earlier this week:

Mike on why he went public with his addiction to prescription drugs: “I thought it would be another good way to hold myself accountable. If you put it out into public, everybody knows it, and maybe it’s not the best decision, but for me it worked. If you put it out there and someone sees you out in public and you clearly look like you’re f’ed up, they know, ‘Oh, well, this guy’s a liar,” and that’s going to get out there. In today’s day and age it’s going to spread everywhere. … Secondly, I almost felt like I had an obligation as someone who was in somewhat of a spotlight to tell my story. To tell people that we have an opioid crisis in this country and it affects everybody. … Even people who look like their lives are in check, they go through it, too.”

Maria on why she and Mike re-signed with WWE last June: “At that time, we had had a lot of conversations with WWE because we were going back and forth on whether or not we wanted to sign. We were disappointed in what had gone on so far. There were a lot of promises made to us that weren’t being held up. So we didn’t even know if we were going to re-sign. So then we finally did, and the only reason why I did was because I had a conversation with them, and I knew that I wanted to have another child, and I didn’t know how long that was going to take. I wanted WWE to know, ‘Hey, we’re going to try and have another child, and if you want to sign me to a part-time deal or pay-per-appearance, whatever, that’s fine.’ Because I knew that, hopefully, in the future I would be leaving on maternity leave. And WWE came back and they’re like, ‘No, we want to bring you in as a full-time talent again and we understand that you want to have a bigger family and have another child, so we’re totally cool with that.’ So when they came back with it, I was like, ‘All right. Great. We’re golden.’”

Maria on her and Mike getting released by WWE in April: “I was all ready to come back at WrestleMania. I had been getting back in shape [after giving birth to the couple’s son, Carver, in February]. I had already lost 35 pounds. So when they started calling around [to release talent], I thought that they were going to fire Mike because Mike had asked for his release. I didn’t think they were going to fire the both of us. I was on my way back from my two-month appointment with Carver at the doctor when I got the call from [WWE director of talent relations] Mark Carrano. I was fine on the phone, but at the same time I realized that we were going to be in a world of hurt. And they knew that. It’s just really hard for me to talk about because that was just such an emotional day. … To be fired in a pandemic, it was just sad to me. From this company that prides itself on being this family-based company, to be fired. I didn’t receive a phone call after I had Carver to ask if I was OK, if the labor went OK. I didn’t receive a phone call seeing how my recovery was going with either of my children. But I received a phone call to be fired in a pandemic.”

Mike on the possibility of returning to ROH: “I would absolutely love to. I’m not going to sugarcoat anything. I would love to. I know the roster, I know how good it is. I’ve worked for the company before. … I’m not pretending I’m going to one place and this and that. I love Ring of Honor. I would love to end up there.”

EDDIE KINGSTON ANSWERS CODY'S TNT TITLE CHALLENGE ON AEW DYNAMITE

Eddie Kingston answered Cody’s TNT title challenge tonight on Dynamite.

The show started with Cody in the ring. Kingston interrupted the ring announcer and cut a promo, tearing down Cody and comparing their own upbringings. He then challenged Cody to a no disqualification match for the title. Cody accepted, starting the match.

The two had a back and forth match, brawling both around and inside the ring. At one point, Kingston introduced thumbtacks and Cody even took a powerbomb into the thumbtacks. Despite this, Cody fought back Kingston with strikes, took him down with a figure four leglock and submitted him to retain the TNT title.

Kingston has recently wrestled for the National Wrestling Alliance, forming a tag team with Homicide. He’s also wrestled for Impact Wrestling in the past, as well as Ring of Honor.

Controversy Over A Brew City Wrestling Show

There is controversy in Waukesha, WI over a Brew City Wrestling show at the Elks Lodge No. 400 after a 6/20 show attracted 300 fans. There are no restrictions in the county regarding a live event although country officials have asked organizations to voluntarily limit events with 100 people indoors for social gatherings.

Waukesha Mayor Shawn Reilly called the shows indoors at this time a bad idea. Covid Tracers United noted attendance figures in the past and noted there will be a show tonight run by Frankie DeFalco in Twin Lakes, WI.

TSN Wrestling - CNWA Match Compilation 1990

SHE ISN'T GETTING OUT ANY TIME SOON AS STATE OF PENNSYLVANIA FILES MOTION TO REVOKE TAMMY SYTCH'S PAROLE

The State of Pennsylvania filed a motion yesterday in Carbon County Court to revoke the February 2020 parole of WWE Hall of Famer Tammy "Sunny" Sytch, PWInsider.com has confirmed.

The motion was filed in the wake of Sytch's arrest in New Jersey on the morning of 7/13 in Middletown, NJ.  Sytch remains incarcerated at the Monmouth County Correctional Institution, charged with with the following:

*Operating a Motor Vehicle during a second license suspension.

*Eluding a Police Officer.

*Contempt/Violation of a Domestic Violence Restraining Order.

Obviously, the State of PA sees Sytch's arrest as a violation of her existing parole.  Court records indicate that until her 7/13 arrest, Sytch had been adhering to her parole requirements, including monthly payments of restitiution.  A hearing has not yet been scheduled but if the court sides with the State, they may rule that Sytch be returned to Carbon County Correctional Facility to serve her full original sentence.

Sytch was paroled in February, having been incarcerated since March 2019 after a bench warrant was issued for her arrest in the State of Pennsylvania on 2/15/19.  That same day, the Carbon County Probation Department filed their motion to revoke her October 2018 parole.  Sytch had missed a scheduled drug test on 2/11 and failed to report as directed to her parole officer.  She had also failed to maintain a stable residence or report her whereabouts.  Court records also indicate that while Sytch made restitution payments of $120 in the months of October and November 2018 as part of an agreed upon payment plan, she had not made any additional payments since that time.

Sytch had been living in New Jersey and has been incarcerated since being arrested on Saturday 2/23/19 when she was pulled over at 6:30 PM on Dupont Avenue in Seaside Heights, NJ by authorities.   Sytch was arrested for driving while intoxicated, which was the sixth time since 2015 that Sytch had been arrested for such an offense. On 2/23/19, Sytch was also given a summons for having an open alcohol container in a motor vehicle, for consumption of alcohol in a Motor Vehicle, reckless driving, failure to stop at a stop sign, driving the wrong way on a one-way street, driving with a suspended driver’s license, and careless driving.   

Sytch was released by the Seaside Heights Police Department and placed into the custody of the Holmdel Police Department when it was discovered that she had outstanding warrants in the jurisdictions of Holmdel, NJ Police Department for $1,500.00 and Knowlton, NJ Police Department for $1,000.00. Sytch had been charged with Contempt of court - Disobedience/Resistance of Court Command in relation to each of those warrants.  Sytch remained incarcerated in Monmouth County Correctional Facility in Freehold, NJ until being transferred back to Pennsylvania on 3/20/19.   

That transfer was the second time in two years that Sytch was extradited to Carbon County from the Monmouth County Correctional Facility because a bench warrant had been issued in Pennsylvania for Sytch breaking the terms of her parole.    Sytch had been arrested in New Jersey last year for failing to appear in court for two DUI arrests in the Garden State.   While Sytch was being processed for multiple charges of Contempt - Disobedience/resistance in New Jersey, authorities learned that she was technically a fugitive from justice because a motion had been filed in August 2017 in PA requesting her February 2017 parole from the Carbon County in Pennsylvania be revoked.

According to court records, Sytch’s original parole was revoked on 8/25/19.  In October 2019, her then-legal counsel withdrew as Sytch’s attorney.  A new attorney began representing Sytch the same week and filed a petition for her parole on 1/20.

Sytch's original Pennsylvania DUI charges in 2015 were a result of three separate incidents over that summer.

On 5/30/15, Sytch was stopped by Mahoning Township, PA police after being seen driving erratically into a Wal-Mart parking lot. Testing showed she had a 0.25 percent Blood-Alcohol level at the time of her arrest.

On 6/1/15, Sytch was pulled over after her car crossed the solid center yellow line several times, then entered oncoming traffic on Interchange Road in Lehighton, PA.  Sytch was unable to provide proof of insurance or a driver’s license and was identified only after authorities checked records.  Trooper Jonathan Lazarchick of the Pennsylvania State Police reported that her eyes were bloodshot and glassy and that Sytch smelled like alcohol.  Authorities discovered an open bottle of Coors Light in the passenger side of the vehicle as well as another eleven unopened.  The open cap of the Coors Light was on the floor of her passenger's side.  Sytch claimed she had been drinking the night before, was driving to pick up milk and eggs and when asked to get out of the vehicle, staggered, had problems with her balance and needed to lean on her car to maintain her balance.    Her blood-alcohol content was 0.3 percent.

On 6/20/15, Sytch crashed her car into a ditch in Towamensing Township at 10:40 PM, claiming to the responding authorities that her GPS had told her to make a "sudden turn", which caused her to turn wide and end up in the ditch.  Sytch told authorities that she was unable to back the car back out.   Cpl. Shawn Noonan of the Pennsylvania State Police observed the odor of alcohol and bloodshot eyes.  He requested Sytch take a field sobriety test, but she claimed to be "in too much pain due to her recently blacking out and falling down the steps."  She was placed under arrest for DUI and was given a breathalyzer test back at police barracks.   The results of that test were 0.078 percent.

Sytch stated in a July 2016 interview with Bill Apter that she agreed to the guilty plea because she was "blackout drunk" during what she termed the worse relapse of her life.  Sytch told Apter she legitimately could not remember anything from the arrests.  Since she could not testify in court about what happened and knowing the police had video footage of her in her inebriated state, Sytch stated a decision was made to plead guilty as part of an agreement.  In the interview with Apter, Sytch had praised Judge Joseph T. Matika for being so lenient with her and allowing her to do the time in rehab as opposed to potential jail time.

On 8/18/16, Judge Matika sentenced Sytch to 97 days in prison, only to then give her credit for 95 days in rehab.  The final 60 days were paid for by World Wrestling Entertainment, which had reversed a previous stance that cut her off from assistance via their Wellness Policy after Sytch criticized the previous rehabs WWE had chosen to send her in a DVD interview.  Sytch was also given two days' credit for two days spent in jail.

At the time, Sytch was also sentenced to five years of probation with a required bi-weekly alcohol testing as well as 125 hours of community service and fines of $2,100. She was released without spending a day in prison but was warned by Judge Matika that if she got into trouble at any point during her five-year probation, there would be consequences. 

Just 18 days into those five years, Sytch was arrested in Northampton County, PA.  In that case, Sytch plead guilty to driving without a license, driving an unregistered vehicle, operating a vehicle without required financial responsibility (no insurance), displaying plate card in improper vehicle (license plates placed on a car to which they didn't belong), operating a vehicle without valid inspection, and driving without Evidence of an Emission Inspection, which is required in State of PA).     Sytch was also fined $1,496.45 as part of an agreement that saw Prosecutors drop the most severe charge against her, receiving stolen property.  Prosecutors also opted to drop a charge of fraudulent use or removal of registered licensed plates.

On 9/12/16, Sytch was rushed from her home in Palmerton, PA to Palmerton Hospital. That day, she was charged with possession of alcohol as well as being under the influence of alcohol - both of which violated the zero tolerance of her probation.

On her Facebook page at the time, Sytch referred to her hospitalization as being related to her pancreas.   In Sytch's autobiography A Star Shattered, which had been released earlier in 2016, Sytch wrote that past health issues involving pancreatitis were brought on by her heavy drinking and had nearly led to her death in a previous incident.  In the book, Sytch wrote that she had been warned by doctors that if she did not stop, it would lead to her death.

Sytch later wrote on social media that she had been released from the hospital on 9/20/16.   Police sources in Palmerton, PA later confirmed to PWInsider.com that just three days later, 9/23/16, Sytch was brought back again to Palmerton Hospital after authorities were called to her home.   Court records cite that on that date, Sytch was again charged with being under influence of alcohol, a third violation of the zero-tolerance policy of her probation.   Shortly thereafter, Sytch was taken into custody (apparently from the hospital) and transported directly to the Carbon County Correctional Facility.

It was less than six weeks after her five-year probation began.

Sytch remained incarcerated for five months, becoming paroled in February 2017 after she agreed to once again attend a WWE-sponsored rehab.  When Sytch was released, the court ordered her to directly report to an in-patient drug rehab in Hanover, PA, successfully complete the program as well as any after-care recommendations.  Sytch was also ordered to report to the Carbon County Probation Office upon completion of the program and to perform an additional 75 hours of community service, which now added up to a total of 200 hours. 

According to court records, Sytch was informed that she would have a "zero-tolerance" threshold for the possession, control and consumption of alcoholic beverages and/or non-prescribed medication and that she would have "zero-tolerance" for any missed urine screens without a legitimate excuse.   Sytch was also warned that a failure to adhere to the Judge's order would result in a petition to revoke her parole. 

It appeared to be the beginning of the end of that chapter of Sytch's life.  It wasn't.  Just a little over six months later, a petition was filed on 8/22/17 before the court requesting that Judge Matika revoke Sytch's parole.  A bench warrant for Sytch's arrest was issued the following day, but until she was arrested in New Jersey, officials had been unable to serve the warrant and apprehend Sytch.  Amazingly, Sytch had been making independent bookings and signing appearances all over the United States prior to her NJ incarceration back in February 2018, including a signing in Philadelphia, PA in January of that year.

Sytch's 2018 New Jersey arrests stemmed from incidents where she was charged with DUI on 1/23 at 8:53 PM and then charged with DUI and Leaving the Scene of an Accident following a 2/2 incident where Sytch had been in a car accident at 8:52 AM, alleging fleeing the scene of the accident. 

Sytch has been through several personal and legal issues over the last decade, including a period in 2012 and 2013 where she was arrested arrested five times over the span of a month after, on three separate occasions, she violated an order of protection taken out by a former boyfriend in Connecticut.   Sytch was also charged with disorderly conduct, third degree burglary, and three counts of violating a protective order.   In that case, Sytch served 114 days in jail before being released, at which point she moved to PA.

Sytch was inducted into the WWE Hall of Fame in 2011 and is considered the original "WWE Diva."  She first broke into the business in Smoky Mountain Wrestling in the early 1990s before being signed to WWF as an announcer and later a manager.  She left WWF in 1999 to work for the original ECW and had a run in World Championship Wrestling as well.  At one point, Sytch was the hottest female talent in professional wrestling and was the most downloaded celebrity on AOL back in 1997.

After her 2018 parole, Sytch announced she would be embarking on a farewell tour on the independent wrestling scene, writing, "I'm pleased to announce that I am taking bookings for my "Comeback/Farewell Tour 2018-19"...I am taking bookings for personal appearances, autograph signings, wrestling shows and party appearances for what will by my FINAL 9-12 months of appearances before I call it a wrap!   I am returning to school and leading life after next year as a 'normal' member of society with a private personal life.   28 years in this crazy business has been long enough!"

I guess those fans who subscribed to her "OnlyFans" account won't be getting anymore nude pics from her any time soon. So they may as well start cancelling that subscription.
